Two of Sanjay Dutt's properties attached






MUMBAI: The Bombay high court on Tuesday ordered the attachment of two properties owned by actor Sanjay Dutt following an arbitration award passed by the Indian Motion Pictures' Producers Association (IMPPA) in January. The attached properties are the actor's flat in the Imperial Heights building at Pali Hill, Bandra (W) and his office-Sanjay Dutt Productions-in the Mayfair Melody building, Santa Cruz (W). 


The order was passed on an application filed by producer Shakeel Noorani, who had claimed Rs 2.03 crore from the actor, including the Rs 50 lakh he had paid Dutt as signing amount for an under-production film Jaan Ki Baazi. 


In case of financial disputes of this nature, there is an agreement between the Cine Artistes' Association and the IMPPA which provides for arbitration. The agreement empowers the IMPPA to act as an arbitrator and pass an order. In October, the IMPPA had applied for the execution of a decree. Last week, the high court's execution department had issued a warrant under the Civil Procedure Code against Dutt, following which notices of attachment of properties were pasted on his properties, said Noorani's lawyer Ashok Saraogi. 


Dutt has 30 days to pay Noorani, failing which his properties will be auctioned. The actor can also challenge the order in the high court. Dutt has not yet challenged the IMPPA's award, said Saraogi. Terming the order 'arbitrary' and 'illegal', Dutt's lawyer Satish Maneshinde said, "No evidence of payment of cash was produced (by Noorani). We will challenge the order in the high court only after the Christmas vacations."The IMPAA award stated that Noorani had paid Rs 50 lakh to Dutt for his film in October 2001. The film is only 50% complete because the actor allegedly failed to give dates for shooting. As a result, said the award, the producer suffered a financial loss of Rs 1.53 crore, which was payable to financiers. 


It further mentioned that the IMPPA had called Dutt for a hearing and that the arbitration committee adjourned the case twice on his request. "On another occasion, he failed to appear," the award said.
